'How Dare They': CJI Fumes Over Greater Noida Magistrate's Notice To CJP Protester Despite 'No Action' Order

Delhi Student Protest: The Supreme Court on Wednesday slammed the Greater Noida Executive magistrate for issuing a notice to a law student for allegedly campaigning for participation in the Cockroach Janata Party (CJP)-led students protest in Delhi. While hearing the case, Chief Justice of India (CJI) Surya Kant asked how could a magistrate violate the orders passed by the Supreme Court.

'How Could Magistrate Violate Order?'

He questioned how could the magistrate issue such an order when the apex court had squashed the FIRs over the protesters and barred any future coercive action against them. "How could a Magistrate dare to issue notice? We made clear no coercive action against any student! No Magistrate could violate that order," CJI Surya Kant pointed out.

Senior Lawyer Raises Issue

While raising the issue before the bench, Senior Advocate Bishwajit Bhattacharyya stated that a notice was served to a second-year student of the Gautam Buddha University. The senior lawyer, while citing the media reports, stated that the notice was later withdrawn, but it still violated the directives issued by the top court.

"This is an experiment with students of India. This is prima facie contempt. Authorities of Noida and UP can't create fear psychosis among students," the lawyer submitted, reported Live Law.

Upon listening to his argument, CJI Surya Kant clarified that there was no question of issuing notice to any student after the apex court had made its point clear. "There's no question of taking action against any youth in view of our categorical and clear order. Nobody dare violate our orders," said the CJI.

Bring On Record The Notice: SC

The court further asked the lawyer to bring on record the notice through a petition, adding that it will seek an explanation from the authority. Earlier in July, in an agreement with the CJP delegation, the centre agreed to squash criminal charges against the protest across the country.
