A major debate has begun across the country after the Ministry of External Affairs remarked that an Indian passport is not, by itself, conclusive proof of Indian citizenship. The statement has triggered widespread discussion on social media and caused political uproar, raising a fundamental question: if Aadhaar, Voter ID, and even a passport are not considered proof of citizenship, how can one establish that they are an Indian citizen?

Speaking during the 14th Passport Seva Diwas celebrations on June 24, the Ministry of External Affairs clarified that the primary purpose of an Indian passport is to facilitate international travel and establish the holder's identity and nationality abroad.

There Is No Single Citizenship Document in India

Unlike some countries that issue dedicated citizenship certificates or national identity cards, India does not have a single document that proves citizenship for every citizen.

Under the Citizenship Act, 1955, citizenship is determined through legal criteria such as place of birth, date of birth, and, in certain cases, the citizenship status of parents. This simply means that while documents such as Aadhaar cards, voter IDs, and passports are important supporting records, they are not treated as standalone legal proof of citizenship.

Citizenship by Birth: What Indian Law Says

According to the Citizenship Act, 1955:

- Anyone born in India between January 26, 1950, and July 1, 1987, is generally considered an Indian citizen by birth, regardless of their parents' nationality.

- Anyone born in India between July 1, 1987, and December 3, 2004, is considered an Indian citizen if at least one parent was an Indian citizen at the time of birth.

- Anyone born in India on or after December 3, 2004, is considered an Indian citizen only if one parent is an Indian citizen and the other parent is not an illegal migrant.

Which Documents Can Help You Establish Citizenship?

Since no single document serves as definitive proof, authorities may examine a range of records to verify a person's citizenship status. These may include:

  • Birth Certificate
  • School records and transfer certificates
  • Passport
  • Voter ID Card
  • Aadhaar Card
  • Driving Licence
  • Government-issued property and land records
  • Insurance records
  • Other government documents containing details of birth and identity

The relevance of each document depends on the circumstances of the case.

Why Aadhaar, PAN and Other IDs Are Not Enough?

Aadhaar is designed to establish identity and address, not citizenship. Foreign nationals who meet residency requirements can also obtain Aadhaar, which is why it cannot serve as proof of citizenship.

Similarly, PAN cards are issued for taxation purposes, while driving licences certify an individual's eligibility to drive. Neither document is intended to determine nationality or citizenship status.

Even Voter ID cards and passports, despite being strong supporting documents, are not legally regarded as final proof of citizenship when examined in isolation.

In simple terms, Indian citizenship is generally established through a chain of documents rather than a single certificate, including an individual's entire documentary history, birth records, parental details, educational documents, and other official records.
